Usually when parents file for divorce or legal separation, one of the most contested issues between them is child support. Since child support payments determine how well a child will be provided for, both parents need to know how child support payments will be calculated in Illinois.
While child support payments from a non-custodial parent to a custodial parent in Illinois used to be calculated using a percentage of the non-custodial parent's income, this is no longer the case. Following a modification to Illinois law that went into effect in July of 2017, child support payments are now determined based on both parents' combined income and each parent's percentage share of that combined income.
To calculate child support payments, a "basic child support obligation" will be determined based on the parents' combined income and the number of children they share. This amount will represent what the parents would have spent to provide food, clothing, and shelter for their children if they were still married. The amount of the obligation will be divided between the parents based on their percentage share of the combined income. In most cases, the custodial parent who has the majority of the parenting time will receive child support payments from the other parent.
In some cases, each parent's amount of parenting time may also be factored in to the child support calculations. This will be necessary in "shared physical care" situations where children will spend at least 40% of their time, or 146 overnight stays per year, with each parent. Parents may also be required to divide the costs of expenses related to the child's needs, such as medical, dental, and daycare.
